Indemnification
You agree to indemnify FaxMate®, its subsidiaries, representatives and employees from any claim or demand, including solicitors' fees, arising out of your use of FaxMate®  services, including any violation of this Agreement by you or any other person using your account, or any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other customers and infringement of intellectual property or other rights.

Number Ownership
Individual numbers given out by FaxMate® to our clients are obtained as a block of numbers and as they are part of a block, they are non portable.  As a result, non portable telephone numbers assigned to you will be unavailable for your use with another telecommunications company if your FaxMate® account is terminated or suspended for any reason.

Only individual numbers that have been ported to FaxMate® or a block of numbers that have been obtained specifically on a customers behalf are able to be ported out again.

Cancellation
FaxMate® may discontinue FaxMate® services without liability, for any of the following reasons:
1. Non-payment of any monies due for any services.
2. Abuse of service
3. By court order
4. A violation of any law or regulation of any governing authority having jurisdiction over the service.
5. The Customer provided false or misleading credit information.

Privacy
As a part of the FaxMate® privacy policy, we do not save or store copies of faxes so we are unable to store, forward or resend any unread or unsent messages to you or any third party.

Disclaimer
FaxMate® does not warrant that its fax service will be error free or uninterrupted. Its services are provided on an "as is" basis without warranties of any kind, either expressed or implied. FaxMate® will not be responsible for any losses, damages or costs that you and/or your business may suffer when using the website or service. You agree to indemnify and hold harmless FaxMate® from any claims resulting from your use of the website or service. You expressly agree that use of the website or service is at your sole risk. Neither FaxMate® or its service providers, agents, licensors, employees shall be liable for damages suffered by you or any other party as a result of the use or misuse of the service.

Legals
1. This Agreement is governed in all respects by the laws of Queensland;
2. Both parties agree that any legal action relating to FaxMate® services shall be done in Brisbane, Queensland
3. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions of this Agreement shall remain in full force and effect;
4. You cannot assign or transfer this Agreement and any right under this Agreement, any such attempt is void.

Changes
FaxMate® reserves the right to make changes to pricing or to the terms and conditions of the FaxMate® service. Continued use of the FaxMate® service or the non-termination of your account after changes are posted constitutes your acceptance of said changes.
